This was passed unanimously by the National Executive Committee on July 14.
WHEREAS, the Constitution of the United States establishes that no person is above the law and that public officials are accountable to the American people; and
WHEREAS, concerns have been raised regarding actions taken by the Trump administration and whether certain actions may have violated legal or constitutional standards; and
WHEREAS, allegations of misconduct, abuses of power, corruption, obstruction of justice, and other violations of law by public officials must be investigated through lawful and impartial processes; and
WHEREAS, Congress has a constitutional responsibility to conduct oversight of the executive branch and to investigate credible allegations of wrongdoing; and
WHEREAS, the preservation of democratic institutions requires a commitment to constitutional government, the rule of law, and equal justice under the law;
THEREFORE, BE IT RESOLVED, that upon obtaining a majority in the United States House of Representatives following the 2026 elections, Democratic members of Congress should vigorously exercise their oversight authority and investigate any credible allegations of misconduct, corruption, abuses of power, or violations of federal law by current or former public officials; and
BE IT FURTHER RESOLVED, that any such investigations should be conducted fairly, transparently, and in accordance with the Constitution, federal law, and due process; and
BE IT FURTHER RESOLVED, that candidates seeking the Democratic nomination for President in 2028 should clearly state their commitment to upholding the rule of law and ensuring that any individual found through appropriate legal proceedings to have committed crimes against the United States or violated constitutional obligations is held accountable under the law; and
BE IT FINALLY RESOLVED, that SDUSA reaffirms its commitment to constitutional democracy, equal justice, and the principle that no person, regardless of position or political affiliation, is above the law.
